What is Private School Services
Under the Title II, Part A program, local educational agencies (LEAs) are required to provide educational services and other benefits for private school children, teachers and other educational personnel, equitable in comparison to services and other benefits for public school children, teachers and other educational personnel, pursuant to section 8501(a)(3)(A) of the Elementary and Secondary Education Act (ESEA), amended by the Every Student Succeeds Act of 2015 (ESSA). Private schools must hold non-profit status in order to be eligible to receive funds.

Parentally Placed Private School Students
- Private school students with suspected disabilities are entitled to the same evaluation and identification services as public school students (Child Find). This includes any student attending a private school in Broward County even if the student lives in another county.
- Private school students with disabilities are NOT entitled to an individual education plan (IEP) or the same special education and related services as public school students.
- Private School Service Plans- any parentally placed private school student with a disability whom an LEA elects to serve must have a Service Plan, to the extent appropriate, meets the content requirements for IEP’s and is developed, reviewed and revised consistent with the IEP process.

Parent Rights
- Parents do have recourse to due process to resolve disagreements about the evaluation and eligibility process.
- Parents do NOT have recourse to due process to resolve disagreements about private school service plans, but can use the state complaint process.
- Private schools have recourse to the state complaint process to resolve disagreements about their consultation or the District Services Plan.

Child Find
- At no cost to the parents
- Involves the multi-tiered system of support (MTSS) and Response to Intervention (RTI)
- Full and Individual Evaluation: assessments in all areas of suspected disability
- Full and Individual Evaluation completed within 60 student school attendance days after date consent is received.
- Committee makes eligibility determination
- This includes any student attending a private school in Broward County even if the student lives in another county.
